What PECR covers
The Privacy and Electronic Communications Regulations govern marketing calls, texts, emails and cookies in the UK. UK GDPR governs how you handle the personal data behind them.
The key rules
• Texts and emails to individuals: generally need specific consent, except the “soft opt-in” for existing customers (similar products, opt-out offered each time). The Data (Use and Access) Act 2025 extends a soft opt-in to charities.
• Live marketing calls: must not be made to numbers registered with the Telephone Preference Service (TPS) or Corporate TPS unless the person has specifically consented to calls from you.
• Automated (recorded) marketing calls: need specific prior consent.
• Identify yourself and show a caller line identity.
Higher fines from 2026
